Florida §553.899 — Milestone inspections for condo and co-op buildings

Section 553.899 requires condominium and cooperative buildings three or more stories high to undergo a milestone inspection at 30 years (25 near salt water) and every 10 years thereafter.

What the statute requires

Obligations

  • Apply milestone inspections to buildings three or more stories under Florida Building Code, owned as condominium (Ch. 718) or cooperative (Ch. 719), reaching 30 years from certificate of occupancy — or 25 years where the local agency requires it in salt-water proximity.

  • Complete a Phase 1 inspection — a qualitative visual assessment of major structural components — by a licensed architect or engineer.

  • Trigger a Phase 2 inspection only when Phase 1 identifies substantial structural deterioration; Phase 2 may include destructive or nondestructive testing and a repair recommendation.

  • Complete Phase 1 within 180 days of local-agency notice, and submit a Phase 2 progress report within 180 days of Phase 1 submission.

  • Re-inspect every 10 years after the initial milestone inspection.

  • Engage a licensed architect (Ch. 481) or engineer (Ch. 471) authorized to practice in Florida, with one serving as the registered design professional in responsible charge.

  • Submit a sealed, signed inspection report to the local building official within 180 days, and distribute the inspector-prepared summary to unit owners within 45 days via mail, personal delivery, or electronic consent.

  • Post the summary conspicuously on the property and on the association website if the §718.111(12)(g) website rule applies.
